A federal judge has ruled the immediate discharge of Kilmar Abrego Garcia from detention by ICE, concluding his continued confinement is without lawful basis.
"Since his release after wrongful imprisonment in El Salvador, he has been taken back into custody, again without legal justification," Judge Paula Xinis wrote in her ruling.
The case stems from a erroneous removal to El Salvador earlier this year, which the government later admitted was an mistake. After his return to the United States to answer human smuggling allegations, he was detained in federal custody.
In her decision, the judge pointed out that the government lacks a valid deportation order, which effectively blocks them from removing Mr. Abrego Garcia "at this juncture."
